Is It A Crime To Threaten Someone With Harm Or Death In Ghana?

A couple days ago, a contractor for Migrating Culture made some death threats that involved Juju toward one of the company executives, Brandon Rogers, and his family. After Brandon's wife went into labor at seven months the contractor was arrested and charged with a threat of death.

The contractor went before the judge and was arraigned. The judge gave him a 100,000 Ghs bail amount and someone signed for him to make bail. His court date has been set to November 17th, and he must answer the charges.

And just like clock work, the defendant's family and friends all showed up to ask that the charges be dropped. But none of them went to their relative and friend and asked that he show remorse for his death threat. So, until this date, he has shown no remorse, he has offered no apology, and he continues to lie about the death threat.

Many people have commented that there is no way to connect the defendant to the murder of the unborn baby or anything related to Juju. Yes, that may be true, but it's actually pretty irrelevant to the case. As I stated, the contractor was arrested for making a threat of death and that is a criminal offense in Ghana.

According to the Criminal Code of 1960 (Act 29) there are specifically two sections that deal with this matter. The first is Section 74 - Threat of Harm which states, "Whoever threatens any other person with unlawful harm, with intent to put that person in fear of unlawful harm, shall be guilty of a misdemeanor. The second is Section 75 - Threat of Death which states, "Whoever threatens any other person with death, with intent to put that person in fear of death, is guilty of a second degree felony.

From my research, a second degree felony can carry up to 10 years of imprisonment. So, making a death threat here in Ghana, if is nothing happens as a result is still a criminal offense.

There was at least four witnesses who all have written statements to the police that they overheard the defendant making a death threat. So, the prosecutor need not argue anything related to Juju or attempt to connect the threat to the death of the baby. A serious law was broken and the prosecutor has more than enough evidence to prove that.
